COUNCILLORS are set to discuss proposed fees for taxi licensing in St Helens.
The licensing and environmental protection committee will meet on Wednesday, March 30.
Members will be provided with the proposed fees for taxi licensing for the period April 2022 to March 2023.
The committee is recommended to consider that the fees recommended are to be set in accordance with the Local Government (Miscellaneous Provisions) Act 1976, sections 53 and 70, and to authorise the licensing manager to place the public notice to advertise the new fees for a period of 28 days.
The report to members says the setting of fees for taxi licences is a non-executive function pursuant to the Local Government (Miscellaneous Provisions) Act 1976, sections 53 and 70.
It adds: “There is a legal procedure which must be followed when setting such fees and failure to adhere to this would render the fees invalid.
“The authority has a statutory power to levy appropriate fees to recover the costs of the issue of a licence and the delivery of the directly associated service provision.
“The authority is not permitted to set fees which would produce a profit and are legally obliged to carry forward any credit balance accrued on the taxi licensing budget.”
